Terms and Conditions – Industry E-Cart
1. Acceptance and Cancellation of Orders
Acceptance of orders is subject to written acknowledgement by Industry E-Cart. Any written acknowledgement of receipt of an order shall not, in and of itself, constitute such acceptance. Orders accepted by Industry E-Cart may be cancelled by the customer only upon written consent of Industry E-Cart, provided the orders are not NCNR – Non-Cancellable Non-Returnable. Customer requests to reschedule shipments are subject to acceptance by Industry E-Cart at its sole discretion. Orders cannot be cancelled or rescheduled after being submitted by Industry E-Cart to the shipment center. Industry E-Cart reserves the right to allocate sales and limit quantities of selected products.
2. Credit Policy
Industry E-Cart operates on a “Pay and Purchase” model and does not extend credit to its customers. Purchases and payments can be made as per the instructions on the website.
3. Returns
Returns are generally not encouraged by Industry E-Cart. However, under extraordinary circumstances, returns may be accepted with written approval from Industry E-Cart. This does not apply to NCNR orders.
4. Prices
All prices for supplies provided by Industry E-Cart are in INR and exclusive of all central, state, or local taxes or other governmental charges unless expressly stated otherwise. Prices are subject to change prior to the completion of the order. Additional charges for transport and handling will be added at the time of dispatch and are payable by the customer.
5. Payments
All payments will be made in INR only. Industry E-Cart accepts payments through Visa and Mastercard. Customers can wire funds to our bank. A Proforma invoice will be emailed, including our bank information, merchandise total, and shipping charges. Stock for orders will be reserved for 72 hours awaiting funds. Orders will be canceled after 20 business days if funds are not received. Customers are responsible for duties and taxes.
6. Sales Tax
All applicable taxes under Indian law, such as VAT, GST charges, and any other taxes, are the customer’s responsibility and are due at delivery.
7. Product Information
Industry E-Cart strives to provide current and accurate product information but does not guarantee its currency or accuracy. Information is subject to change without prior notice.
8. Late Payments and Dishonoured Cheques
Customers shall pay all costs incurred by Industry E-Cart in collecting dishonoured cheques or past due amounts, including court costs, collection costs, and advocate’s fees. All cases are subject to the jurisdiction of Karnataka, India.
9. Out of Stock
If a product is out of stock at the time of order placement, customers may elect to have it shipped on a subsequent shipment. Additional shipping charges will apply to each shipment.
10. Export Compliance
All orders of international origin or destination are subject to export control laws. Customers agree to comply with all applicable export control laws and are responsible for obtaining any necessary licenses or official authorizations.
11. Return Policy
In most cases, Industry E-Cart will not accept merchandise returns. Under special circumstances, products may be replaced, or money refunded at the customer’s option.
12. Product Warranty
All products are sold on an as-available basis. Industry E-Cart agrees to transfer to customers any warranties received from manufacturers, to the extent transferable. Manufacturer’s warranties are available prior to purchase.
13. Limited Liability
Industry E-Cart is not liable for any special, incidental, or consequential damages, including loss of profit or revenue. Customer’s recovery from Industry E-Cart for any claim shall not exceed the purchase price paid for the goods. Customers shall indemnify Industry E-Cart from any claims brought by other parties regarding products supplied by Industry E-Cart and incorporated into the customer’s product.
14. Intellectual Property
If an order includes software or other intellectual property, it is provided subject to the copyright and user license terms. No rights or licenses are granted to use any software or intellectual property in any manner not expressly permitted by the license agreement.
15. Force Majeure
Industry E-Cart will not be liable for delays or failure to perform due to causes beyond its reasonable control, including product allocations, material shortages, labor disputes, transportation delays, unforeseen circumstances, acts of God, acts of civil or military authorities, government priorities, fires, strikes, floods, severe weather conditions, computer interruptions, terrorism, epidemics, quarantine restrictions, riots, or war. Delivery times will be extended by the period of such delay.
16. Standard Delivery
Goods in stock will be dispatched within 4-6 days of order. Delivery charges apply for orders below INR 5000, excluding taxes and discounts. Extra charges may apply for delivery, packing, and insurance in transit. The company reserves the right to deliver or perform in installments.
17. Inspection, Defects, and Non-Delivery
Customers must inspect supplies as soon as practicable after delivery and notify the company of any defects within 7 days. The company will not be liable for any defects unless written notice is given within 7 days of delivery. Non-delivery or non-performance must be reported within 7 days of the expected delivery date.
18. Description
All descriptions, specifications, and illustrations are intended to give a general idea of the supplies and do not form part of the contract. The company relies on supplier information and excludes liability for any errors or omissions.
19. Risk & Ownership
Risk of damage or loss passes to the customer upon delivery. Ownership of goods passes to the customer upon full payment. Until then, goods must be held on a fiduciary basis, insured, and stored separately.
20. Lien
The company has a general lien over all goods for sums due. After 14 days’ written notice, the company may sell such goods to satisfy any sums due.
21. Promotions
Promotional materials sent to customers are subject to these terms and conditions.
22. Jurisdiction
All contracts are governed by the laws of India. The courts of Bangalore, Karnataka have jurisdiction over any disputes arising from these conditions or any contract.
23. Access to the Site
Registration is required to place an order or use the site. Expanded services are available through a name/password-protected system.
24. Technical Assistance
Industry E-Cart provides technical assistance as a convenience. It does not guarantee the accuracy or completeness of information provided and is not liable for any reliance on such information.
25. Content Inaccuracies
The content may contain errors or inaccuracies. Industry E-Cart reserves the right to correct any errors without prior notice and is not obligated to make such corrections.
26. Support & Links – Third Party
Links to third-party websites do not imply endorsement. Industry E-Cart is not responsible for the availability or content of such websites.
27. Advertisements – Third Party
Any dealings with third-party advertisers are solely between the customer and the advertiser. Industry E-Cart is not responsible for any part of such dealings.
28. Communication Services
Communication services on the site must be used only to post, send, and receive proper messages and material related to the service.
29. Geographic Limitation
Not all products or services are available to all persons or in all locations. Customers must comply with all applicable laws regarding the transmission of technical data, content, and online conduct.
30. Indemnification
Customers agree to indemnify and hold harmless Industry E-Cart and its affiliates from any claims arising from their use of the site, reliance on information provided, or violation of these terms.
31. Trademarks and Logos
No rights or licenses are granted to use any trademarks or logos without written consent. Industry E-Cart is not responsible for the accuracy of third-party documents and product details.
